These Terms of Service ("Terms") govern your use of the website sonic-barrier.us ("the Site") operated by RankForge LLC, doing business as Sonic Barrier ("we", "us", "our"). By accessing or using the Site, you agree to be bound by these Terms.

These Terms apply to your general use of the Site. Purchases made through the Site are additionally governed by our General Conditions of Sale. In case of conflict between these Terms and the General Conditions of Sale regarding a purchase, the General Conditions of Sale shall prevail.

1. Eligibility By using this Site, you represent that you are at least 18 years of age or the age of majority in your jurisdiction. If you are using the Site on behalf of a minor in your care, you accept these Terms on their behalf.

2. Use of the Site You agree to use the Site only for lawful purposes and in accordance with these Terms. We reserve the right to modify any telephone number used to operate this service at any time, with notice. Limitation of Liability To the fullest extent permitted by law, Sonic Barrier, its officers, employees, affiliates, agents, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or any products purchased through it. In jurisdictions that do not allow such limitations, our liability shall be limited to the maximum extent permitted by law.

Indemnification You agree to indemnify and hold harmless Sonic Barrier, its parent company, affiliates, officers, directors, employees, agents, and suppliers from any claims, demands, or damages, including reasonable attorneys' fees, arising from your breach of these Terms or your violation of any law or the rights of any third party.

12. Arbitration and Class Action Waiver

12.1 Arbitration. By using or purchasing Sonic Barrier products or services, you agree that any controversy, claim, or dispute between you and Sonic Barrier arising out of or relating to: (a) these Terms, or the breach thereof; (b) your access to or use of the Site, services, or materials; or (c) any alleged violation of any federal, state, or local law (each a "Claim"), shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association in accordance with its applicable rules.

The arbitrator shall issue a reasoned written award including all findings of fact and law. Each party shall bear its own attorneys' fees, expert costs, and other expenses.

12.2 Arbitration Procedures. Claims shall be heard by a single arbitrator. Arbitrations shall be held in Bernalillo, New Mexico, United States, but parties may choose to appear in person, by phone, or through submission of documents. The arbitration shall be governed by the Federal Arbitration Act and the internal laws of New Mexico, without regard to conflicts of laws principles. If the arbitrator determines the FAA does not apply, New York law governing arbitration agreements will apply.

12.3 Opt-Out. You may opt out of arbitration within 30 days of your first purchase by mailing written notice to: RankForge LLC, 1209 Mountain Road PL NE STE N, Albuquerque, NM 87110. Include your name, address, and a clear statement that you do not wish to resolve disputes through arbitration. Opt-out requests received after the 30-day deadline are not valid.

12.4 Class Action Waiver. You and Sonic Barrier agree that Claims may only be brought in your individual capacity, not as a plaintiff or class member in any class, consolidated, or representative proceeding. The arbitrator may not consolidate claims of multiple parties unless both parties agree in writing.

13. Severability If any provision of these Terms is found to be unlawful or unenforceable, that provision shall be enforced to the fullest extent permitted by law, and the remaining provisions shall remain in full force and effect.

14. Governing Law These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, United States.

15. Changes to These Terms We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of the Site after any changes constitutes acceptance of the new Terms.
